Greene County district court, week ending Feb. 27

In Greene County district court Scott Dean Brackett, 49, of Jefferson was sentenced to two years in prison after he changed his plea to guilty to a charge of possession of marijuana- third or subsequent offense. The prison term was suspended and he was placed on probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. His driver’s license was revoked for 180 days. A judgment was entered against Brackett for a $625 fine with a $218.75 surcharge, a $120 Law Enforcement Initiative surcharge, a $10 drug abuse resistance education (DARE) surcharge, $90 restitution for his court appointed attorney’s fees and $180 court costs. Maxwell Steven McGlothlen, 21, of Ankeny was sentenced to two years in prison after he changed his plea to guilty to one charge of driving while license barred. The prison term was suspended and he was placed on probation for two years. A judgment was entered against McGlothlen for a $625 fine with a $218.75 surcharge and $161.12 court costs. A second count of driving while license barred, as well as charges of assault on a peace officer and possession of marijuana were dismissed. Additionally, a magistrate case in which McGlothlen was charged with assault, harassment-third degree and disorderly conduct was dismissed. (Sentencing: Kester)

Jose Luis Gutierrez Franco, 30, of Norfolk, NE, was granted a deferred judgment after he changed his plea to guilty to a charge of operating while intoxicated (OWI)-first offense. He was placed on informal probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense, and he must complete a community college drinking drivers course.  Guiterrez Franco must pay a civil penalty of $1,250. Half the penalty will be waived if he obtains a temporary restricted license.  He must also pay $100 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: Kester)

Laryssa Shelbi Bushman, 20, of Scranton was granted a deferred judgment after she changed her plea to guilty to a charge of OWI-first offense. She was placed on informal probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense.  Bushman must pay a civil penalty of $1,250. Half the penalty will be waived if she obtains a temporary restricted license.  She must also pay $100 restitution for her court appointed attorney’s fees and $100 court costs. (Sentencing: Kester)

Delaney Monica Brakey, 24, of Boone was fined $1,000 after she changed her plea to guilty to a charge of driving while license revoked. She must also pay a $350 surcharge, a $10 DARE surcharge, $180 restitution for her court appointed attorney’s fees and $100 court costs. (Sentencing: Kester)

Mark Anthony Salinas, 18, of Jefferson was granted a deferred judgment after he pleaded guilty to a charge of possession of marijuana. He was placed on informal probation for one year. He must pay a civil penalty of $315, a $125 LEI surcharge, $90 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: Kester)

Persons pleaded not guilty in Greene County district court as follows: Russell Lee Gardner, 39, of Jefferson, possession of marijuana-second offense and OWI-second offense, and in a separate case, domestic abuse assault- third or subsequent offense; Kimberly Marie Smith, 41, of Jefferson, harassment-first degree; Gabriel Jamison Wiggins, 18, of Jefferson, possession of marijuana; and Anthony Paul Tasler, 40 of Polk City, OWI-first offense. Trial dates were set for May 12 in every case.

Cases were initiated in district court during the week ending Feb. 27 as follows: Kyle Jo Freese, 29, of Glidden, driving while license barred; Ricardo Emmanuelle Rodriguez, 29, of Manhattan Beach, CA, assault on a peace officer and public intoxication-third or subsequent offense; Joseph Robert Hupp, 22, of Scranton, OWI-first offense; and Collin Daniel Richards, 18, of Jefferson, theft-first degree and possession of marijuana.
